Blogging, a tricky affair ? Part-IX

Contd from Part VIII

In last post I mentioned about plagiarism. Here is my article, a slightly different version of which was published in Blogadda.com a few months back.

You must have heard the word plagiarism. Ever wonder what does it mean and why we should know about it ?

Any of the following is considered plagiarism.
•    turning in someone else’s work as your own
•    copying words or ideas from someone else without giving credit
•    giving incorrect information about the source
•    changing words but copying the sentence structure of a source without giving credit
•    copying so many words or ideas from a source that it makes up the majority of your work, whether you give credit or not

In other words, plagiarism is an act of fraud. It involves both stealing someone else’s work and lying about it afterward (either by refusing or by not giving due credit).

I happened to be a victim of plagiarism many times. Several of my creations including my poems and travel photos have been lifted by others without my knowledge.

Here I will explain you the legal aspects, implications and my experiences and how to deal with it.

The expression of original ideas is considered intellectual property, and is protected by copyright laws, just like original inventions. Almost all forms of expression fall under copyright protection as long as they are recorded in some way such as a book, a computer file, a painting or even a blog.
At one time, a work was protected by copyright only if it included a copyright trademark (the © symbol). However, now as per the laws, our works are by default copyright protected with or without the inclusion of this symbol.

Anyone who reproduces copyrighted material improperly can be termed as violator of the Copyright Act and can be prosecuted in a court of law. It doesn’t matter if you intend to plagiarize or not, ignorance is never an excuse.
In the eyes of the law any form of plagiarism is an offense that demands punitive action.

Most cases of plagiarism are considered misdemeanors and are punishable by fines of $100 to $50,000 and up to one year jail-term.
But in a case where a plagiarist copies and earns more than $2,500 from copyrighted material, plagiarism is considered a serious crime. He or she may face up to 100 times ($250,000) in fines and up to ten years in jail.
However, in India the laws are not so well defined. Generally it is acted upon in haphazard manner after somebody complains or the media cries over the issue. Sometimes if it takes a shape of copyright infringement, it takes a serious turn.

What do I do when someone steals my material ?

I do not take harsh steps in the beginning. I start with leaving a comment on the plagiarist’s blog mentioning his/her mistake and the consequences. In most cases, it suffices since the plagiarist is ignorant about it.
In two cases, the plagiarist tried to be extra smart and kept deleting my comments. Then I requested some of my readers and they too left comments condemning the deed (My experience says sometimes just one comment from me is not enough).
Mission was achieved.

In another case, the plagiarist completely ignored our comments. Then I wrote a post citing the details and we (me & my dear readers) invited his readers to my blog. Some of my readers went to his regular readers’ blog and told them about it. Quite a few of them were shocked because till then he was accepting praises for the posts which were stolen by him !
They all confronted him, and he had to publically apologize on my blog. Needless to say he also deleted my copyrighted posts and photos.

There was only one case who did not accept that he did any wrong, rather accused me of stealing his material !!
But I had enough evidences to prove my point. I had to ultimately report to his blogging platform that definitely did not approve such misdeeds and promptly deleted his entire blog and banned him from further blogging.

So that was my story and I am glad to say that till date I did not have to resort to the ultimate step of knocking the doors of court but I’ll not hesitate if the need arises. So, be careful !!! :P

How to prevent plagiarism
There is nothing much we can do here except…
1)    Display copyright policy or badge on your blog
2)    Watermark all your photos
3)    Enable word verification etc. to avoid spam.
4)    Contemplate of giving a partial feed
5)    And keep your eyes open

How can you copy if you have to copy ?

1)    Put within quotation marks everything that comes directly from the text of the owner.
2)    Paraphrase but be sure you are not just rearranging or replacing a few words. Changing only the words of an original source is NOT sufficient to prevent plagiarism. You must cite a source whenever you borrow ideas as well as words.
3)    Give credit to source, but sometimes giving credit is not enough and they expect you to ask for their permission. Check for any such copyright policy.

    I agree of course with all that you state here, but personally I must say that I don’t care if anyone “steals” anything from my blog. Of course I would prefer that they do it openly, declare the source … and possibly make a link to my blog! Then I’m just happy!

    This was a really informative post. Wow. I dont know what I’d do if my posts ever got plagiarized. I’d be heartbroken because my posts are so personal to me and are a part of who I am. I’m glad you stood up for yourself and claimed ownership to your posts from the person who stole them. I cant believe someone would stoop to that level to take someone else’s words and claim them as their own.

    कुहू जी, अन्तरजाल कॉपी करने को रोक पाना यदि असंभव तो नही पर बहुत मुश्किल है। इसके लिये चिन्ता करना अपने को परेशान करना है। मैंने इस विषय पर यहां और यहां लिखा भी है।

    मैं अपने सारे लेख, पॉडकास्ट पूरी तरह से कॉपीलेफ्टेड हैं और क्रिएटिव कॉमन शून्य (Creative Commons-0 1.0) लाईसेन्स के अन्दर हैं। यह इनके द्वारा निकाला नया लाइसेन्स है। इसमें लेखक कोई भी अधिकार अपने पास नहीं रखता है। इसकी शर्ते आप यहां देख सकते हैं। इसमें सबको मेरे लेखों, पॉडकास्ट को कॉपी करने, सशोंधन कर अपने नाम से छाडने, चुराने सबकी स्वतंत्रता है।

    इसके अपने फायदे भी हैं। उनमें से एक फायदा यह भी है। मैं नहीं जानता यह कौन शख्स है जो यह कर रहा है, मेरी इनसे न ईमेल पर न ही कभी बात हुई है मैं यह भी नहीं जानता कि वह इतने पैसे और समय क्यों खर्चा कर रहा है :-)
